Terms of Service

These Terms of Service ("Terms") govern your use of the Undercurrent mobile application ("App"), published by Grayforge Labs ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Undercurrent, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Description of the App

Undercurrent is a personal health pattern tracking tool that helps you log daily events (symptoms, food, medications, activities, and observations) and discover correlations over time. The App stores data locally on your device and includes features for pattern detection, timeline visualization, AI-powered insights, and report generation.

3. Not Medical Advice

Undercurrent is not a medical device, diagnostic tool, or substitute for professional medical advice, diagnosis, or treatment. The App is designed to help you observe and record patterns in your daily life. Any insights, patterns, or correlations presented by the App are for informational purposes only.

You should always consult a qualified healthcare provider before making any health-related decisions. Never disregard professional medical advice or delay seeking it because of information provided by the App.

4. Eligibility

You must be at least 13 years of age to use Undercurrent. If you are under 18, you should use the App under the supervision of a parent or legal guardian. Parents and caregivers may use the App to track health patterns for children and dependents.

5. Your Data and Privacy

Your data is stored locally on your device. We do not collect, access, or store your personal or health data on our servers. For full details on how data is handled, please refer to our Privacy Policy.

You are solely responsible for maintaining and backing up your data. Uninstalling the App will permanently delete all locally stored data.

6. In-App Purchases

Undercurrent offers a free tier with core features and a one-time Premium purchase that unlocks additional features. Premium is a single, non-recurring payment processed through Apple's App Store. Purchase management is handled by RevenueCat, a third-party service that communicates with Apple to verify and manage your entitlements.

• No subscriptions: Premium is a one-time purchase. There are no recurring charges.
• Purchase management: We use RevenueCat to manage purchase verification and entitlements. RevenueCat receives transaction data from Apple (such as purchase status and product identifiers) but does not receive your health data or any content you log in the App. See RevenueCat's Privacy Policy for details.
• Refunds: Refund requests are handled by Apple in accordance with their App Store policies. We do not process payments directly.
• Feature availability: We reserve the right to modify, add, or remove features in future updates. Core functionality available at the time of purchase will be maintained.

7. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to any part of the App or its systems
• Use the App for any unlawful purpose
• Redistribute, sublicense, or resell the App or any part thereof
• Remove or alter any proprietary notices or labels in the App

8. Intellectual Property

The App, including its design, code, graphics, user interface, and content, is owned by Grayforge Labs and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

The data you enter into the App remains yours. We claim no ownership or rights to your personal data.

9. AI Features

The App includes AI-powered features (including the Curry chat assistant and pattern insights) that run entirely on your device. AI-generated content is provided for informational purposes and may not always be accurate. You should not rely on AI-generated content for medical decisions.

10. Apple Health Integration

If you choose to connect Undercurrent with Apple Health, data is read with your explicit consent and processed locally. Use of Apple Health data is subject to Apple's terms and conditions. You can revoke access at any time through your device settings.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• Any patterns, insights, or correlations identified by the App are accurate or complete
• Any defects in the App will be corrected

12. Limitation of Liability

To the maximum extent permitted by applicable law, Grayforge Labs and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the App
• Any health decisions made based on information provided by the App
• Loss of data due to device failure, app deletion, or any other cause
• Unauthorized access to your device or data stored locally
• Any errors, inaccuracies, or omissions in the App's pattern detection or AI features

In no event shall our total liability exceed the amount you paid for the App (including any in-app purchases).

13. Indemnification

You agree to indemnify and hold harmless Grayforge Labs from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

14. Third-Party Services

The App is distributed through Apple's App Store and is subject to Apple's terms and conditions. Apple is not responsible for the App or its content. Any claims relating to the App should be directed to Grayforge Labs, not Apple.

The App uses RevenueCat for in-app purchase management. RevenueCat processes transaction data from Apple to verify purchases and manage entitlements. No health data or user-generated content is shared with RevenueCat.

15. Apple App Store Terms

The following terms apply when you download the App from Apple's App Store:

• Acknowledgment: These Terms are between you and Grayforge Labs only, and not with Apple. Grayforge Labs, not Apple, is solely responsible for the App and its content.
• Scope of license: You are granted a non-transferable license to use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• Maintenance and support: Grayforge Labs is solely responsible for providing any maintenance and support services for the App. Apple has no obligation to provide any maintenance or support services for the App.
• Warranty: Grayforge Labs is solely responsible for any product warranties, whether express or implied by law. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
• Product claims: Grayforge Labs, not Apple, is responsible for addressing any claims by you or a third party relating to the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
• Intellectual property: In the event of any third-party claim that the App or your use of the App infringes that third party's intellectual property rights, Grayforge Labs, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Legal compliance: You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

16. Termination

You may stop using the App at any time by uninstalling it. We reserve the right to modify or discontinue the App at any time without notice. Upon termination, your locally stored data remains on your device until you delete the App.

17. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
